Terms of Use
In using www.choa.org, you agree to the following Terms of Use:
1. Partner Organizations. www.choa.org is not responsible for the accuracy, integrity, reliability, quality or privacy policies of the information provided by the partner organizations for the www.choa.org website or for the websites of our partner organizations which can be accessed through links from the www.choa.org site. Inclusion of this information and the links does not imply an endorsement by www.choa.org of anything included in such material or on such sites.
2. Privacy. www.choa.org will not sell, trade, rent or otherwise share your personal information to our partner organizations or to any other individuals or companies without your prior consent.
3. Receipts. www.choa.org agrees to provide donors with receipts for tax or other purposes within thirty (30) days of receiving your donation information. Normally a receipt is required from a 501(c)(3) organization when you are claiming a tax deduction of $250.00 or more. If you do not receive such a receipt, please contact childrensgiving@choa.org.
4. Bank. www.choa.org is not responsible for any act or omission of the donor's bank in connection with the processing or handling of any donations made through our site.
5. Fees. Per our agreement with our partner organization, we pay a flat monthly fee to use this service. 100% of your donation is sent directly to the our bank account. Donations made through this service are nonrefundable.
6. Fraudulent Use of Credit Cards. Federal law prevents your bank from holding you liable for more than $50.00 of fraudulent credit card charges. If your card is used fraudulently, through no fault of your own and as a result of your use of www.choa.org, and if our credit card provider holds you liable for any charges, we will compensate you for the amount of your liability up to $50.00.
7. Conduct of Donors. In using www.choa.org, you agree that you will not impersonate or otherwise misrepresent your identity or affiliation with any other person or entity; send junk mail or "spam" including surveys, contests, chain letters or pyramid schemes; modify or delete any materials appearing on the www.choa.org site; interfere with or disrupt the service or servers or networks connected to www.choa.org, or disobey any requirements, procedures, policies, or regulations of networks connected to www.choa.org; attempt to gain unauthorized access to www.choa.org or computer systems or networks connected to www.choa.org through any means; stalk, harass or harm any individual; collect or store data about other users, including email addresses; or violate any applicable local, state, federal, or international law or regulation.
8. Intellectual Property. All content of www.choa.org is protected by copyrights, trademarks, service marks, patents or other intellectual property and proprietary rights and laws and is owned by www.choa.org, our licensors, or our partner organizations. You acknowledge that www.choa.org and any underlying technology used in our service contains proprietary and confidential information of www.choa.org. You may not copy or in any manner commercially exploit any part of the content of www.choa.org.
9. Advice. www.choa.org does not provide legal or financial, including tax, advice and nothing on this site should be relied upon for such advice.
10. Modification of Service and/or Terms of Use. www.choa.org reserves the right to modify any part of the site and service at any time, including the Terms of Use, with or without notice. Any modification shall be subject to the Terms of Use. You should review these Terms of Service periodically and note changes as your continued use of www.choa.org shall be deemed your acceptance of the modifications.
11. Termination and Indemnification. You may discontinue use of www.choa.org at any time. www.choa.org may also choose to deny you access to or use of the website, without prior notice, if you engage in any conduct which Children's Healthcare of Atlanta, in its sole discretion, believes is inappropriate use of the website. You agree to indemnify and hold harmless www.choa.org from any damages and costs arising from your failure to comply with the Terms of Use or from your violation of local, state or federal law.
12. Waiver. Waiver of any Term of Use does not constitute waiver of the all Terms of Use. In the event that one or more of the Terms of Use shall be invalid, illegal or unenforceable in any respect, the validity, legality and enforceability of the remaining provisions shall not be in any way affected or impaired.
13. State of Georgia. The Terms of Use shall be construed and enforced in accordance with, and the rights of the parties shall be governed by, the laws and decisions of the State of Georgia. Any action brought with regard to these Terms of Use shall be brought in the State of Georgia.
14. Entire Agreement. These Terms of Use set forth the entire agreement between you and www.choa.org and supersedes all prior and contemporaneous contracts, representations, and understandings of the parties.
